Social Work in Swiss Prisons: Elements, Limits and Articulations

Background:

Social work has played an important role in the criminal justice system since the profession’s founding. As recent research indicates (Reamer 2004; Young 2015), carceral social work’s position in the criminal justice system is a difficult one, as the system currently adheres to principles of punitiveness, security and increased administrative demands. In addition, social workers only represent a small proportion of prison staff and therefore have limited resources for rehabilitative work. This poses a challenge not only to the carceral social work profession, but also to the rehabilitative
principle of the criminal justice system and of prisons in general.


Rationale:

Various questions arise. First, how can carceral social workers maintain and adhere to professional and ethical principles? Second, is carceral social work limited to social workers, or what constitutes social work or rehabilitative work in the prison setting? Finally, what are the elements and references of carceral social work? This project therefore conceptualises carceral social work not as an isolated practice, but as an agencement (Deleuze & Guattari 1980) that potentially extends beyond the prison walls and includes social work professionals and their practices, as well as the practices of other actors, and relates to the profession as a whole and its ethics and quality standards.


Objectives and aims:

The project is aimed, first, at conceptualising carceral social work in a novel way (agencement) that enhances its understanding in current society. Second, this focus shifts discussions about methods and instruments towards basic reasoning about the restorative function of the criminal justice system and carceral social work. Finally, the project is aimed at bridging the gap between social science research on social work and applied research aimed at practitioners by developing principles and instruments that enable carceral social work to fulfil its restorative function.
Methods. First, carceral social work will be studied in five selected prisons in Switzerland. Second, events during which carceral social work crystallises, such as specific interactions with prisoners or their preparation for prison exit, will be identified to discern other elements (ramifications) of carceral social work (e.g. organisations, other actors, legal texts, ethical principles) both inside and outside the prison. The methods used include shadowing (as a form of observation), in-depth interviewing, mapping (not only of places, but also of the elements of carceral social work) and document analysis. The project focuses on all actors within a prison, beginning with social workers and including prisoners, staff and volunteers.


Expected results:

The project will deliver evidence to critically evaluate carceral social work in times of increasing punitiveness, securitisation and administrative pressure. The results will further our understanding of carceral social work. In addition, the theoretical perspective of relational thinking (agencement) proposes a novel analytical view on the topic. Apart from providing evidence for researchers, the study will also support carceral work in political and practical terms because the project is aimed at development for practical application in carceral social work.

Le vécu de la probation. Une analyse comparative de l’expérience des personnes en libération conditionnelle astreintes: d'un suivi probatoire en Suisse romande et alémanique (EXPRO)

Le vécu des personnes en probation est encore peu exploré en Suisse. La recherche existante au niveau international montre des lacunes tant au plan théorique (flou notionnel), que méthodologique (recours presque exclusif des entretiens semi-structurés). Le présent projet contribue combler ces lacunes en adoptant une méthodologie multisensorielle pour explorer la situation de vie (actuelle) des personnes dans la phase transitoire entre l’incarcération et la liberté. Etant donné qu’en Suisse nous avons deux différents dispositifs encadrant l’exécution des sanctions, une comparaison est envisagé pour explorer l’impact du dispositif sur le vécu. Par l’emploi de méthodes visuelles et corporelles, le projet vise explorer les différentes dimensions du vécu et les appréhender dans leur globalité. Le plan de recherche prévoit un nombre total de 16 personnes dans deux cantons de la Suisse romande et alémanique et plusieurs étapes de récolte de données adoptant différentes méthodes incluant des approches visuelles et corporelles pour appréhender l’expérience au-del du récit réflexif.

Social Work in Closed Settings: Challenges for the Profession,

Description du projet :

Social work is integrated into organisations that can be considered total institutions (Goffman 1977). The extent to which social work has become part of these organisations is illustrated by a quote from a social pedagogue from a correctional institution. "I am like a cog in the wheel" (Borchert 2016: 142). This may come as a surprise, because social work sees itself as a profession with multiple and conflicting obligations (triple mandate, Staub-Bernasconi 2014). In closed settings in particular, however, social work professionals are confronted with an additional form of obligation, namely to the organisation. This is particularly evident in the correctional system, where social work often takes on the institutional mistrust of the institution. Social work professionals become part of the organisation and share the institutional logic of "care" and "custody" of the correctional system (Marti, Hostettler and Richter 2017).

Aim | The project aims to analyse these ambivalences of triple mandate and a loyalty to the organisation. It deals with questions of the professional understanding of social work professionals in closed settings as well as with negotiation practices and the resulting shifts in meaning. The following questions guide the research:

  • How do social work professionals in closed settings define their professional understanding and which discursive patterns do they refer to?
  • What ambivalences do professional understanding, professional practice and the context of the organisation lead to?
  • How do social work professionals deal with these ambivalences and what creative shifts arise in practice as well as in discursive reasoning?

Summary:

Les Établissements de la plaine de l’Orbe (EPO) proposent sur le même site trois établissements de détention ayant des conditions de sécurité variable : le pénitencier de Bochuz, la Colonie fermée et la Colonie ouverte. Ce regroupement géographique favorise le régime progressif d’exécution des sanctions. Ces bâtiments sont organisés par une structure directionnelle commune, composée de deux dicastères : exécution des sanctions pénales et réinsertion. Ce dernier met en œuvre le travail social au sein des EPO et se subdivise en deux secteurs. Le secteur service social traite tant de la régularisation de la situation des personnes détenues au moment de leur arrivée, qu’à favoriser les liens familiaux durant la détention ou à préparer la vie après la sortie. Le secteur FAST (formation, animation, sport et TV), pour sa part, organise tous les loisirs et les formations des personnes détenues. Outre le dicastère réinsertion, on observe que d’autres professionnel·le·s, notamment de sécurité, participent également à des formes de travail qui ont trait au « social ». Ce chapitre propose de mettre en perspective et de présenter ces différents éléments.

Summary:

Time on parole is not only marked by the supervision and support of probation officers but constitutes a particular time in the concerned people’s lives. The experience of this transition period has constituted a topic of research, but most studies have neglected a thorough conceptualisation of the notion of experience and relied empirically on oral data such as interviews. We propose a conceptualisation of experience as lived and embodied, reflected and communicated, and, finally, sedimented. To capture these various dimensions, we developed a multisensorial methodology that explores emotions and places as well as narratives on the experience of the time on parole. Our results concentrate on a group of formerly incarcerated people who are rarely discussed in research: people who were well integrated into society before and who manage to organise their lives afterwards fairly well. They experience distinct challenges and encounter obstacles produced by the criminal justice system itself.

Summary:

Social work’s role in managing the risk of recidivism is increasing in the Swiss penal system. With data from a qualitative study in two Swiss correctional facilities collected during 2019-2020, this article shows that prison social work has a triple role encompassing voluntary social assistance, tasks in relation to the execution of a sentence, and – in the focus of this article – relatively new tasks in line with the risk-minimizing reasoning in prisoner rehabilitative work. The risk-oriented approach, however, is conceptualized under the definitional power of forensic psychology, which assigns social work a subordinate, executing role. While issues of motivating involuntary clients to offence-centred work are intensely discussed in social workers’ reasoning regarding the risk-oriented work, critically questioning social work’s role in the tension between care and control is less evident in the data. We argue that to strengthen the profession’s positioning in the risk-minimizing set of tasks of carceral institutions, a broader interdisciplinary discourse within it is necessary which requires a clear and convincing statement of social work on its possible theoretical and methodical contribution in individual case work as well as on the level of the system as a whole.

This article focuses on the temporal experiences of released prisoners under post-custodial supervision. It provides an understanding of how this transitional period is experienced by the people concerned, while taking a critical look at the institutional framework governing supervision in two Swiss cantons. It shows that while people on parole are subject to an exogenous temporal order, they also develop strategies for managing it.

Summary:

Le délai d’épreuve est vécu de manière très différente par les probationnaires. Tous sont cependant confrontés au défi de réussir à se réinsérer dans la société malgré la stigmatisation dont ils font l’objet. Pour ce faire, l’assistance de probation leur offre diverses formes de soutien, qui sont généralement appréciées, mais parfois aussi considérées comme limitées. Un projet de recherche a, par ailleurs, montré à quel point il est important pour eux qu’on prenne en compte leurs besoins et leur point de vue.

Summary:

Der Begriff der Interdisziplinarität fand über eine wenig formalisierte Leitidee auf Bundesebene Eingang in die 2013 neu geschaffenen KESB. In der politischen Debatte standen strukturelle Fragen der (inter-)disziplinären Besetzung und die Organisationsform im Vordergrund. Die Umsetzung der Interdisziplinarität erfuhr in den verschiedenen Kantonen und Regionen jedoch unterschiedliche Konturierungen je nach gewählter organisationaler Rahmung, der Anordnung der Disziplinen im Spruchkörper wie auch der konkreten Fallbearbeitung bis hin zum interdisziplinär gefassten Entscheid der Behörde. Dieser Artikel zeigt auf, dass eine interdisziplinär besetzte Behörde nicht ein Qualitätsmerkmal an sich darstellt. Es müssen auf strategischer, struktureller und kultureller Ebene der Behörde Rahmenbedingungen geschaffen werden, welche interprofessionelle Zusammenarbeit innerhalb der Behörde ermöglichen, begünstigen und sicherstellen.

Summary:

Social work in prisons not only works with and for people who are confined; it also constitutes a form of social work that is carried out under conditions of confinement. This article draws on carceral geography to understand the corporeal and spatial aspects of social work in prison settings. Based on insights from two prisons in Switzerland, we argue that understanding carceral social work as a spatial and materially situated practice helps to gain deep insight into the intricate layers of meaning and powerful modes of functioning of prisons and of the people involved. In particular, it shows how the way social work is carried out in prison is supported and strongly structured by the spatiality of the prison itself, allowing for counselling, desk-type social work, rather than for social work that actively initiates and creates spaces for encounters or activities.

Summary:

Organisationen können in einer ersten Annäherung als Systeme verstanden werden, die Mitgliedschaftsrollen aufeinander beziehen und dadurch koordinieren. Soweit der Zugang zu bestimmten Rollen an die Zugehörigkeit zu einer Profession, an Zertifikate der Ausbildung in einer Disziplin und entsprechende Praxis gebunden ist, soweit Organisationen also Professionelle als solche beschäftigen, bringen sie sie in ein Kooperationsverhältnis, wobei der Typ solcher Kooperation häufig mit den Begriffen der Interoder der Transdisziplinarität bezeichnet wird. Während „Interdisziplinarität“ auf die Verbindung abgrenzbarer disziplinärer Zugänge zu einem gemeinsamen Gegenstand abhebt, sucht „Transdisziplinarität“ diese Grenzen zu durchbrechen und mehrere Disziplinen (oder Teile davon) zu einem neuen Ganzen zu verbinden. Wo bei dem einen disziplinäre Grenzen bestehen bleiben, um ein gemeinsames Ergebnis zu erzielen, verschwindet beim anderen die je eigene Disziplinarität zugunsten eines neuen übergreifenden Wissenskorpus.
